What is mediation?+

Mediation is a voluntary, confidential, and collaborative process in which a neutral third party, the mediator, helps disputing parties reach a mutually acceptable settlement.

Unlike arbitration, mediation does not impose a binding decision. It empowers parties to find a solution they both agree on.

At CORD, mediation happens entirely online, guided by expert mediators and supported by secure digital tools for document exchange and virtual meetings. The process is designed to be efficient, confidential, and user-friendly.

Is CORD mediation legally recognized in India?+

Yes. In India, mediation is recognized under the Mediation Act, 2023, and supported by provisions of the Code of Civil Procedure, 1908, and the Arbitration and Conciliation Act, 1996 (Part III). CORD's Mediation Rules align with these laws so mediated settlements remain valid, enforceable, and party-driven.

What do we need to file for mediation with CORD?+

To initiate mediation, you'll need the following key elements:

  • Mediation agreement or consent

    A contract clause or written consent between parties referring the dispute to CORD mediation.

  • Request for mediation

    A written request describing the dispute, parties involved, and desired outcome.

  • Registration fee

    Payable upon filing, as set out in the CORD Rules.

  • Representative details

    For parties represented by counsel or authorized signatories.

  • Supporting documents

    Relevant contracts, correspondence, and evidence that clarify issues for mediation.

Once filed, CORD's Registrar appoints an appropriate mediator from its panel, coordinates communication, and schedules online sessions. Resolution is typically targeted within 30 to 45 days of commencement.

“Any dispute, controversy, or claim arising out of or relating to this contract, or the breach, termination, or invalidity thereof, shall first be referred to mediation administered by the Centre for Online Resolution of Disputes (CORD) in accordance with its Rules of Mediation in force at the time of reference. The mediation shall be conducted online, and the settlement agreement, if reached, shall be final and binding on the parties.”
